Why can't BitPay just send the refund back to the address that sent it?

BitPay will refund a payment to either a refund address supplied by a purchaser using the payment protocol specified in BIP0070 or with explicit confirmation from the merchant or purchaser. BitPay will always confirm that a refund address is valid before returning any payment.
